1劳动合同LaborContract甲方：乙方(职工)：PartyA:PartyB(Employee):地址：姓名：Address:Name:法定代表人(主要负责人)：身份证号码：LegalRepresentative(mainresponsibleperson):IDCardNo.:经济类型：户籍地址：EconomicType:HongKong/Macao/TaiwanRegisteredPermanentResidence:联系人：通讯地址：ContactPerson:CommunicationAddress:联系电话：联系电话：Telephone:Telephone:甲乙双方根据《中华人民共和国劳动合同法》(以下简称《劳动合同法》)和国家、省市的有关规定，遵循合法、公平、平等自愿，协商一致、诚实信用原则，订立本合同。InaccordancewiththeLaborContractLawofthePeople’sRepublicofChina(hereinafterreferredtoasthe“LaborContractLaw”)aswellasrelevantprovisionsofthestate,provinceandcity,andonbasisoftheprinciplesoflawfulness,fairness,voluntariness,negotiations,honestyandgoodfaith,PartyAandPartyBconcludethisContract.第一条合同期限与试用期Article1ContractTermandProbation（一）本合同期限类型为固定期限劳动合同。I.ThisContractisafixedtermlaborcontract.1、双方合同期从年月日起至年月日止。1.Thecontracttermisfrom_________(day/month/year)to______(day/month/year).22、若乙方在甲方的实际工作时间与合同约定起始时间不一致的，以实际工作时间为本合同实际起始时间。2.IfPartyB’sactualworkingtimeinPartyAisnotconsistentwiththecommencingtimeagreedinthisContract,thecommencingtimeshouldbecalculatedonbasisoftheactualworkingtime.（二）自本合同生效之日起，从年月日起至年月日为试用期。试用期为个月。在试用期内，甲方认为乙方不符合录用条件的，向乙方说明理由后解除劳动合同。乙方在试用期内出现下列情形之一的，即为不符合录用条件：II.SincetheeffectivedateofthisContract,theprobationperiodshallbefrom____________(day/month/year)to___________(day/month/year),whichis___month(s).Withintheprobationperiod,ifPartyAconsidersthatPartyBisnotqualified,PartyAmaycancelthelaborcontractafterexplainingthereasontoPartyB.PartyBshouldbetreatedasunqualifiedundereitherofthefollowingcircumstanceswithintheprobationperiod:1、违反诚实守信原则，乙方未如实告知与工作相关的信息，包括但不限于教育背景、身体状况、工作经历、联系方式、家庭地址和户籍信息。1.Violatingtheprincipleofhonestyandgoodfaith,PartyBfailstoprovidetheworkrelatedinformation,includingbutnotlimitedtotheeducationbackground,health,workingexperience,contact,homeaddressandregisteredpermanentresidenceinformation.2、乙方的技术及能力不符合甲方或甲方招聘时对岗位职责的描述。2.PartyB’sskillsandabilitycannotmeetthepositionrequirementsdescribedatPartyA’srecruitment.3、乙方未到甲方指定（或许可）的医院进行体检；在体检中有冒名顶替的现象；体检未通过等。3.PartyBfailstogotothehospitalappointed(orpermitted)byPartyAtohavethephysicalexamination;orotherpersonhasthephysicalexaminationinthenameofPartyB;orPartyBfailstopassthephysicalexamination,etc.4、乙方的用工手续不完备或有虚假等，给甲方的录用办理带来影响的，包括但不限于未履行完毕与上家单位的竞业限制约定；未在指定时间内提交甲方需要的必备资料。34.PartyB’sworkingdocuments/materialsareincompleteorfalse,causingimpactonPartyA’semploying,includingbutnotlimitedtothatthenon-competitionagreementwiththeformeremployerhasnotbeenended;PartyBfailstoprovidenecessarymaterialsrequiredbyPartyAwithintheappointedtime.5、乙方不能达到甲方对所担任岗位的要求。5.PartyBfailstosatisfytherequirementsofPartyAfortheexpectedposition.6、乙方在试用期内因身体状况发生变化，无法满足工作岗位的基本要求。6.ThehealthstatusofPartyBchangesduringtheprobationperiod,andcannotmeetthebasicrequirementsoftheposition.7、其他违反法律、法规、规章制度和劳动纪律的行为。7.Otheractivitiesviolatingthelaws,regulations,rulesandlabordisciplines.第二条工作内容和工作地点Article2WorkingContentsandWorkingPlace（一）乙方的工作内容为：____。I.TheworkingcontentsofPartyBare____________.（二）乙方的工作地点为：____。II.TheworkingplaceofPartyBis______________.第三条工作时间和休息休假Article3WorkingTimeaswellastheRestandLeave（一）乙方所在岗位执行标准工时制，具体为：即每日工作小时（不超过8小时），每周工作小时（不超过40小时），每周至少休息一日。I.ThepositionofPartyBenforcesthestandardworkingtimesystem,i.e.working__hourseveryday(notexceeding8hours),__hourseveryweek(notexceeding40hours),andatleastonedayforresteveryweek.（二）乙方加班必须征得甲方书面同意。乙方严格遵守甲方的加班申请报批制度，并同意经批准的加班单为核算乙方加班工资的唯一依据。4II.PartyBshouldobtainthewrittenconsentofPartyAfortheovertimeworking,andshouldstrictlycomplywithPartyA’sovertimeworkingapplicationandapprovalsystem.TheapprovedovertimeworkingsheetshallbethesolebasisofthecalculationofPartyB’sovertimeworkingsalary.（三）乙方有权享受法定假日及劳动法规定的其他假日。III.PartyBislegallyentitledtohavetheholidaysasstatedandinaccordancebylaw.第四条劳动报酬Article4Remuneration（一）甲方依法制定工资分配制度，并告知乙方。甲方支付给乙方的工资不得低于市政府公布的当年度最低工资。I.PartyAshouldmakethesalarypaymentsystemonbasisofthelawandinformPartyB.ThesalarypaidtoPartyBbyPartyAshallnotbelowerthanthelowestsalarypublishedbythemunicipalgovernmentfortheyear.（二）乙方的工资为每月人民币元，试用期的工资为每月元，是乙方在同时满足下列情况下获得的劳动报酬。II.PartyB’ssalaryisRMB___/month,andthesalaryintheprobationperiodisRMB___/month,whichistheremunerationwhenPartyBmeetsbothofthefollowingrequirements:1、在考勤周期中，达到全勤：1.Achievingfullattendanceduringtheattendancecheckingperiod;2、在该工作岗位全面履行本合同劳动义务。2.FullyperformingtheobligationsunderthisContractfortheposition.（三）甲方每月日发放工资。甲方至少每月以货币形式向乙方支付一次工资。III.PartyAshallpaythesalaryon__everymonth.PartyAshallmakeatleastonepaymentofsalarytoPartyBeverymonthintheformofmoney.5（四）甲方安排乙方延长工作时间或者在休息日、法定休假日工作的，应依法安排乙方补休或支付相应工资报酬。IV.IfPartyAarrangesPartyBtoworkovertimeorworkontherestdayorstatutoryholidays,PartyAshouldmakeupPartyB’smissedrestorpaythecorrespondingsalaryinaccordancewiththelaw.（五）若乙方未出满全勤，按照国家规定执行。V.IfPartyBfailstohavethefullattendance,relevantstateprovisionsshouldbeimplemented.（六）工资支付：VI.Salarypayment甲方代扣国家法律法规的社会保险个人应缴纳部分和个人所得税后，每月25日之前发放给乙方工资。如果甲方迟延向乙方付款，乙方同意工资发放相应顺延。Afterwithholdingthesocialinsurancewhichshouldbepaidbyindividualsandtheindividualincometaxprovidedbythestatelawsandregulations,PartyAshoul
